Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") form a binding agreement between you and SA Educação e Tecnologia LTDA ("Pluma," "we," "us," or "our"), operator of the Pluma platform available at plumaedu.com (the "Service"). By creating an account, starting a free trial, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

You represent that you are at least 18 years old (or the age of majority in your state) and have the authority to enter into these Terms. The Service is intended for teachers, educators, and other education professionals; it is not intended for use by children.

If you use the Service on behalf of a school, district, or organization, you represent that you are authorized to bind that entity to these Terms.

2. Description of the Service

Pluma is a subscription-based platform that gives educators access to a library of ready-to-use educational resources (including activities and downloadable PDFs) and to artificial intelligence ("AI") tools that generate pedagogical documents and drafts.

New subscribers may be offered a 7-day free trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and the applicable fees will be charged as described in the "Payment" section below. Trial availability and eligibility may be limited to first-time users.

We may add, modify, or discontinue features, content, or portions of the Service at any time. We strive to keep the library and tools available but do not guarantee that any specific resource or feature will remain available.

3. Account Registration and Responsibilities

To use most features, you must create an account and provide accurate, current, and complete information. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

You agree to notify us promptly at [email protected] of any unauthorized use of your account or any other security breach. Accounts are personal to you and may not be shared, sold, or transferred without our prior written consent.

You are responsible for any content and data you upload or enter into the Service, including any data you provide to the AI tools, and for ensuring you have the right to use that content.

4. Payment, Automatic Renewal, and Cancellation

Paid subscriptions are billed on a recurring basis (for example, monthly or annually) at the price and billing cycle shown at checkout. Payments are processed by our third-party payment processor, Stripe, using the payment methods it supports, which may include credit and debit cards and, in Brazil, Pix. We do not store your full card number.

Your subscription renews automatically at the end of each billing cycle at the then-current price until you cancel. You authorize us and Stripe to charge your payment method for each renewal. We will provide notice of material price changes as required by applicable law.

You may cancel at any time through your account settings or by contacting [email protected]. Cancellation stops future renewals; it takes effect at the end of the current billing period, and you retain access until then. Except where required by law, fees already paid are generally non-refundable and we do not provide prorated refunds for partial periods. Nothing in these Terms limits any non-waivable refund or cancellation rights you may have under applicable law.

5. License to Use the Materials

Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the resources, PDFs, and AI-generated documents made available through the Service for your own personal and classroom teaching use with your students.

You may download, print, and reproduce materials only to the extent reasonably necessary for that permitted educational use. You may not sell, sublicense, redistribute, publish, post to file-sharing or resource-marketplace sites, or otherwise make the materials available to third parties outside your classroom, whether for free or for a fee.

This license ends when your subscription ends, except that you may retain copies of materials you already downloaded for your own continued classroom use, subject to the restrictions above. We reserve all rights not expressly granted.

6. Use of the AI Tools

The AI tools generate a draft intended as a starting point for review by a qualified education professional. Outputs may contain errors, omissions, or inaccuracies and must be reviewed, edited, and validated by you before any use. You remain solely responsible for the final materials and for any decisions based on them.

The AI tools do not provide medical, psychological, clinical, or legal advice and do not produce any diagnosis. They do not replace professional pedagogical assessment or the judgment of qualified specialists. Any references to special-education needs (such as ASD, dyslexia, or ADHD) are for general educational support only and are not clinical determinations.

We strongly recommend that you do not enter students' sensitive or identifying personal data into the AI tools. Use anonymized references instead (for example, "Student A" or initials). You are responsible for the data you submit and for complying with applicable privacy laws and your school's policies. See our Privacy Policy for more information.

7. Prohibited Conduct

You agree not to: (a) use the Service for any unlawful purpose or in violation of these Terms; (b) copy, scrape, reverse engineer, or attempt to extract the source code or underlying models of the Service; (c) resell, redistribute, or commercially exploit the materials or the Service; (d) upload malware or interfere with the security or operation of the Service; or (e) attempt to gain unauthorized access to any account, system, or data.

You also agree not to use the AI tools to generate content that is unlawful, harmful, infringing, or harassing, or that includes sensitive personal data you are not authorized to process.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or engaged in conduct that harms the Service, other users, or us.

8. Intellectual Property

The Service, including the platform, the resource library, templates, software, trademarks, logos, and all related content (excluding content you submit), is owned by Pluma or its licensors and is protected by copyright, trademark, and other intellectual property laws. The "Pluma" name and logo are our trademarks and may not be used without our permission.

We do not claim ownership of the content you submit to the Service. As between you and Pluma, you retain your rights in that content, and you grant us a limited license to host and process it solely to operate and provide the Service to you.

Any feedback you provide is voluntary, and we may use it without any obligation to you.

9. Disclaimers and Limitation of Liability

The Service and all materials and AI outputs are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free or that outputs will meet your requirements.

To the fullest extent permitted by law, Pluma and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "last updated" date and take reasonable steps to notify you, such as by email or an in-Service notice.

Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree, you should stop using the Service and may cancel your subscription.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Piauí, Brasil, United States, without regard to its conflict-of-laws rules, except to the extent preempted by federal law.

Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Piauí, Brasil, Piauí, Brasil, and you consent to personal jurisdiction there. This does not limit any right you may have to bring claims in small claims court or under the mandatory consumer-protection laws of your state of residence.
